• Article 80 (Attempts) or Article 82 (Solicitation): If the expression goes beyond mere opinion and involves attempting to commit or soliciting others to engage in murder/assassination, these apply. Solicitation includes encouraging or advising someone to commit an offense like murder. 
• Article 94 (Mutiny or Sedition): Covers intent to usurp or override lawful military authority, which could extend to seditious speech advocating violence against citizens if it promotes disloyalty or rebellion. Courts-martial for such offenses require proof of intent and context, but even non-criminal administrative actions (e.g., reprimands, loss of security clearance, or separation) are common outcomes.

DoD Policies on Extremism and Threats 

• DoD Instruction 1325.06 (Handling Protest, Extremist, and Criminal Gang Activities): Explicitly prohibits “advocating or engaging in the use or threat of unlawful force or violence in support of extremist activities.” Extremism is defined broadly to include ideologies that promote violence, discrimination, or overthrow of the government. Supporting assassination of civilians (e.g., being “happy about it” in a public post) could be flagged if it aligns with extremist views, such as targeting groups based on politics or religion  Active participation (e.g., joining groups that advocate such violence) is banned, but even passive support like social media likes or comments can lead to scrutiny.

 City Police Bomb Squad and Unified Fire Authority Arson/Bomb Squad responded to a suspicious device located under a news media vehicle in Salt Lake City. The device was determined to be real and had reportedly been lit but failed to function as designed, according to the Salt Lake City Police. Due to the nature of the incident, jurisdiction was assumed by the FBI’s Field Office in Salt Lake City, with the devices being traced back to two suspects at a residence in Magna, located on the 2700 South block of 8500 West. On Saturday, the FBI served a federal search warrant at the residence with the help of local authorities’ bomb squads to ensure that the residence was cleared of any explosive devices. Both suspects were found at the residence and arrested, with squad members clearing the home finding two hoax weapons of mass destruction inside, along with two firearms, bomb making equipment, and illegal narcotics. The suspects were arrested on two counts of weapon of mass destruction – manufacture/possess/sell/use, a first-degree felony; attempted aggravated arson, a first-degree felony; four counts of explosive/chemical/incendiary – possessing parts, second and third-degree felonies; and two counts of threat of terrorism – use of weapon/hoax mass destruction, a second-degree felony.
