The President can invoke the adjournment power granted under Article II, Section 3 of the U.S. Constitution to resolve a disagreement between the House and Senate on the timing of adjournment, effectively forcing both chambers into a recess of sufficient length (at least 10 days, per the Supreme Court’s ruling in NLRB v. Noel Canning) to enable recess appointments.  This power has never been used in U.S. history but was explicitly noted as a potential mechanism by the Supreme Court in Noel Canning (both in the majority and concurring opinions) to allow the President, with sufficient allies in Congress, to bypass pro forma sessions designed to block recesses.

In the scenario where the Senate is holding pro forma sessions (short, no-business meetings every three days to avoid being considered in recess) while the House seeks a full recess, the process could unfold as follows to trigger this power:

• Under Article I, Section 5, Clause 4 of the Constitution, neither chamber can adjourn for more than three days without the other’s consent, typically achieved via a concurrent resolution passed by simple majority in both.
• The House (assuming it is aligned with the President and willing to facilitate recess appointments) would pass a concurrent resolution to adjourn for at least 10-11 days.  
• If the Senate refuses to concur—consistent with its pro forma strategy to stay technically in session and block recess appointments—this creates a formal “disagreement” on the time of adjournment.  
• The President could then step in to adjourn both chambers for a period he deems appropriate (e.g., 10+ days), creating an enforced recess during which the Recess Appointments Clause (Article II, Section 2, Clause 3) allows temporary appointments without Senate confirmation; these appointments would expire at the end of the next Senate session.  This approach is controversial and untested, potentially inviting legal challenges (as seen with President Obama’s attempted recess appointments during pro forma sessions, which were invalidated in Noel Canning), but it remains a constitutional option if the President has support in at least one chamber.

 

No separate statute or law beyond the Constitution itself is required or available for this purpose.

Supreme Court to Rule on ‘Race Based’ Congressional Districts – Would Give Republicans a MASSIVE Advantage in 2026 Midterms

• The U.S. Supreme Court signaled  that it is likely to rehear Louisiana v. Callais, a case that challenges the idea of race-based congressional districts. If they rule against this, other states are going to follow.
• This would give Republicans a huge advantage heading into the 2026 midterms. Democrats could lose as many as 25 seats, just through redistricting.
• The reaction from Democrats would be nuclear. Remember how awful they were during the Kavanaugh hearings? Imagine that times 100.

Trump’s DOJ Launches NATIONWIDE Voter Roll Investigation Ahead of Midterms (VIDEO)

• President Trump’s Department of Justice has officially launched a sweeping nationwide investigation into bloated and corrupted voter rolls across the United States.

•   the effort comes directly from a March executive order signed by President Trump, tasking Attorney General Pam Bondi and the DOJ with coordinating with state attorneys general to investigate and prosecute illegal voter registrations — including felons, dead voters, and foreign nationals.
• On March 25, 2025, President Trump signed Executive Order 14248, titled “Preserving and Protecting the Integrity of American Elections.”
• The order directed Attorney General Pam Bondi to coordinate with state attorneys general and election officials to identify and investigate “suspected election crimes” (e.g. voter fraud or illegal registrations).
• It instructed the DOJ to enter information-sharing agreements with states so that any evidence of ineligible voting or registration discovered at the state level would be reported to federal authorities.
• A major focus was placed on purging ineligible names from voter rolls and prosecuting unlawful registrations.
• The DOJ was ordered to review voter lists for individuals who are not eligible to vote, including people with felony convictions, deceased individuals, and non-citizens, and to assist states in prosecuting such cases where appropriate.
•  In fact, the text of the order directs the Attorney General to “coordinate with State attorneys general” to pursue foreign nationals unlawfully registered or voting in U.S. elections and to enforce federal laws barring non-citizen voting.
• It also mandates enforcement of existing list-maintenance laws (like the National Voter Registration Act and Help America Vote Act) that require removal of deceased or otherwise ineligible voters from the rolls.
• Attorney General Pam Bondi has already dispatched teams to problem states like California, Texas, and Minnesota.
• Maine Secretary of State Shenna Bellows (D) confirmed during a press conference that her state received a DOJ letter, and that according to NASS, all 50 states will eventually receive similar requests.
