When a subject is in custody and is being interrogated, police MUST read a suspect their Miranda Rights prior to any interrogation - but it is not that straight forward during a street encounter or an investigative detention. The courts will examine a number of factors to determine if a suspect is in custody for the purposes of Miranda. Join J.
