The Elkhart 4. In October of 2012, three teenagers and an adult decided to rob a house. Another teenager in the group stayed across the street. Either as a lookout or because he lost his nerve. Finding one that appeared vacant they knocked and rang the doorbell to make sure that the house was indeed empty. Soon after kicking the back door in, two of the four who had entered had been shot by the homeowner. He had finally awakened and had feared for his life. The oldest of the five died. Another was wounded in the leg. Here is where the situation takes an unexpected turn. The county prosecutor charged the remaining four, including one who had been across the street during the crime, with felony murder. Was this overkill? Or was it warranted?
