Announcer: It’s time to LIFT your business and your life on the Circle Legal Business Fix-It Show with your hosts Kelley Keller and Susan Gunelius. Learn how to build a business you love on a solid foundation that delivers the future you want for you and your family. Here are your hosts, Kelley and Susan.
Kelley Keller: Innovative companies, business owners, and families, welcome to the Circle Legal Business Fix-It Show where you’ll learn to LIFT your business and your life with help from recognized legal and business experts you can trust. I’m your host, Kelley Keller, coming to you from the iHeartMedia studios in Harrisburg and with me is my co-host Susan Gunelius who is joining us remotely via video conference. Hi Susan are you there?
Susan: I am here. I’m looking forward to today’s show Kelley.
Kelley: Yes, it's Q & A day on the Circle Legal Business Fix-It Show which is actually going to be the first of its kind and something I hope that we get to do more often. Before we get to the questions, I just want to remind our listeners, especially if there’s any new listeners that are joining us this week, that the Circle Legal Business Fix-It Show is all about building and maintaining a solid LIFT Foundation.
What does that mean? LIFT represents the essential Legal, Insurance, Finance, and Tax building blocks of your business. Without a strong LIFT Foundation, meaning each of those critical systems is strong, in place, and properly managed, even the most innovative companies will fail. It’s simply non-negotiable.
So continuing in the theme of building and maintaining the LIFT Foundation, we’ve been getting questions in through our email, through the website, and Susan, I think you’ve gotten some off of Twitter, and we decided to take them and dedicate an entire show to answering them because our last segment, which is reserved for listener questions, just isn’t doing the trick right now. So what do you have for us today?
Susan: Well, I took some time and I kind of divided questions up into categories so our listeners know when they really need to pay attention if it’s a hot topic for them. So our first topic is going to be things related to intellectual property and branding, but stay tuned because later in the show we’re going to have questions about legal issues, finance, tax issues, and don’t forget you can submit your questions for future shows at CircleLegalRadio.com or visit us on Twitter, we’re @CircleLegal, and you can Tweet us your questions using #CLRadio, and we’ll try to answer them in the future.
So Kelley, our first question is a trademark question which is your expertise.
"Can I trademark my logo if it uses clipart or images I purchased on iStockPhoto.com or another image site?"
This is a great question. This is something that I’ve had clients ask me before and I’d love to hear your legal perspective, too.
Kelley: Well the short answer is no. The whole point of having a logo, a business name, or any type of other unique slogan is to actually be unique in the marketplace. So if you’re using something that is available to millions
