How to Comply with the New Clery, VAWA & Campus SaVE Rules

October 17, 2014

Regulations on stalking and personal advisors could pose challenges for colleges. The U.S. Department of Education has released the final rules implementing the Violence Against Women Reauthorization Act of 2013, which amended the Clery Act. Colleges and universities will now be required to compile statistics on dating violence, domestic violence, sexual assault and stalking, in addition to other crimes already required under the Clery Act.

The new rules involving stalking, however, may pose the most challenges to colleges, according to Laura Dunn, who is a victims rights lawyer, survivor of campus sexual assault and founder of SurvJustice, a victims’ advocacy organization.

Laura also says institutions of higher education might struggle implementing the requirement that the accuser and accused have equal opportunities to have others present – including the advisor of their choice – during disciplinary proceedings.
